DiveJourney Terms of Use

1. Acceptance
By creating an account or using DiveJourney, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.
2. The Service
DiveJourney lets people discover dive spots, log dives, post reviews/photos, and connect with other divers. We may change or discontinue features at any time.
3. Safety and Risk
Diving, freediving, and snorkeling involve serious risks. Content on DiveJourney is community-provided and informational only. We do not guarantee accuracy or safety. You are solely responsible for training, equipment, planning, and checking local conditions and regulations. Always dive within your certification and with a buddy.
4. Age
You must be 16+ in the EEA/UK and 13+ elsewhere to use the service.
5. Accounts
Provide accurate information; keep credentials secure; you are responsible for activity under your account.
6. User Content and License
You own your content. You grant DiveJourney a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute your content to operate and promote the service. You represent you have rights to any content you post. We may remove content that violates these Terms or the law.
7. Community Rules
No illegal content; no harassment; no dangerous misinformation; no IP infringement; no doxxing; no spam or scraping. Respect local rules and the environment.
8. Buddy and Visibility Controls
Buddy and profile visibility features are opt-in. Public profiles may be seen by others. City-level map presence is opt-in and does not display names by default. You can modify these settings at any time.
9. Paid Plans
If you purchase a Pro subscription, you authorize recurring charges until you cancel. You can cancel at any time in Settings; access continues until the end of the billing period. Fees are non-refundable except where required by law.
10. Intellectual Property
The service, software, and branding are owned by DiveJourney or its licensors.
11. Notice and Takedown
If you believe content infringes your rights, email support@divejourney.io with details (including URLs). We may remove content and/or terminate repeat infringers.
12. Third-Party Services
Maps (Mapbox/Geoapify), analytics, email delivery, and other integrations are provided by third parties subject to their own terms and policies.
13. Third-Party Bookings, Referrals, and Insurance
Some parts of DiveJourney may include links, widgets, or modules from third-party partners, including liveaboard booking platforms, activity providers, accommodations, transport providers, or insurance providers.
If you click, request a quote, or complete a purchase through one of these links or modules, DiveJourney may receive referral revenue, affiliate commission, or other compensation.
Unless we explicitly state otherwise, any reservation, booking, quote, insurance policy, claim, payment, cancellation, refund, support request, or dispute related to a third-party provider is solely between you and that provider and, where relevant, the operator or insurer. Their terms, privacy policy, cancellation rules, policy wording, and eligibility requirements apply.
DiveJourney is not the insurer and does not guarantee pricing, availability, coverage, claim outcomes, trip execution, or the performance of any third-party provider.
You are responsible for reviewing operator requirements, experience prerequisites, cancellation terms, and policy wording before purchase.
We may label some links or modules as Featured Local Operator, External Booking Partner, Insurance Partner, or similar. Those labels indicate the type of commercial relationship and do not by themselves guarantee ranking based on payout.
14. Termination
We may suspend or terminate accounts for violations. You may delete your account at any time.
15. Disclaimers
The service is provided "AS IS" without warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy.
16. Limitation of Liability
To the maximum extent permitted by law, DiveJourney is not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for all claims in any 12-month period is capped at the greater of USD 100 or the amounts you paid for the service in that period.
17. Indemnity
You agree to defend and indemnify DiveJourney from claims arising out of your content or your breach of these Terms.
18. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, United States. Exclusive jurisdiction and venue lie in the state and federal courts located in Travis County, Texas.
19. Changes
We may update these Terms; continued use means acceptance of the updated Terms.
